La loi\u00a0\u00a0de 2005, privil\u00e9giant une logique inclusive, a transform\u00e9 un syst\u00e8me \u00e0 deux fili\u00e8res en un syst\u00e8me \u00e0 fili\u00e8re unique \u2013 organis\u00e9e sur\u00a0\u00a0la question\u00a0\u00a0des savoirs. Mais s\u2019il n\u2019y a plus qu\u2019une seule fili\u00e8re en droit, dans les faits il en existe encore deux : les structures de l\u2019\u00e9ducation nationale (g\u00e9n\u00e9rales et sp\u00e9cifiques) et celles du secteur sanitaire et social.\u00a0\u00a0Il y a donc d\u00e8s lors un v\u00e9ritable\u00a0\u00a0\u00ab hiatus structurel \u00bb dans le syst\u00e8me \u00e9ducatif\u00a0\u00a0fran\u00e7ais. D&rsquo;une part, il s&rsquo;agit de relever les paradoxes structurels d&rsquo;un double syst\u00e8me, les contradictions entre les possibilit\u00e9s offertes par la loi et les pratiques qui perdurent malgr\u00e9 ces changements.
